RESTAURANT CHAIN SETTLES I-9 DISCRIMINATION CLAIMS
Denny's Restaurant's Inc. has settled a case brought against it by the Department of Justice for discrimination against foreign nationals in the I-9 employment authorization verification program. Under the settlement the company will pay ,400 in fines and will retrain managers at each of its 1,700 locations in the employment verification program. The Justice Department began the 18 month-long investigation of Denny's after receiving reports that managers were requesting specific types of documents from potential workers. The 1986 Immigration Reform and Control Act, which made employers responsible for verifying employment eligibility, also prohibits employers from requiring specific documents.
This case shows how important it is for employers to be familiar with the I-9 process. While the fine itself does not seem large, less than ,000, combined with the cost of retraining all managers and the negative publicity surrounding the fine, the costs incurred are quite large.
