INTELLIGENCE AGENCY POLICY AGAINST HIRING THOSE WITH NONCITIZEN RELATIVES CHALLENGED
A straight A student from California is challenging the National Security Agency’s refusal to give him a scholarship because his grandmother is a citizen of Taiwan, claiming it is unconstitutional discrimination on the basis of alienage. The student, known only as Edward in court papers, is a US citizen, as are his parents. His grandmother has been a permanent resident of the US since 1989.
The American Civil Liberties Union has filed a class action lawsuit on his behalf and others in similar situations, claiming the NSA’s actions violate constitutional guarantees of equal protection and due process. In their rejection letter sent to Edward, the NSA told him “Because a member of your immediate family is not a US citizen, we cannot process your application.” The letter further states that he would be ineligible for necessary security clearances.
The NSA is responsible for US intelligence activities focused on communications and cryptology, the science of code breaking. It is a highly secretive agency, and employs some of the best scientists and mathematicians in the country.
