DEADLINE FOR FILING DERIVATIVE ASYLUM CLAIMS COMES END OF FEBRUARY
The deadline for people who were granted asylum over two years ago to petition INS for a grant of derivative asylum status to a spouse or child is February 28, 2000. INS regulations require Form I-730 Petition for Asylee Relative and all supporting documentation to be received for each qualifying family member by February 28, or no more than two years after the principal was granted asylum, whichever date is later. This means that people who were granted asylum more than two years ago must file an I-730 petition right away if they want to bring over a spouse or child.
After February 28, 2000, an asylee will be allowed to petition for a relative only within two years of the grant of asylum. If no petition is filed within the two-year period, the asylee’s family members will be allowed to immigrate only through normal family immigration routes.
