DEADLINE FOR FILING FOR ADJUSTMENT OF STATUS FOR NICARAGUANS, CUBANS AND HAITIANS RAPIDLY APPROACHING
The INS has issued a reminder that the deadline for filing adjustment of status applications under the Haitian Refugee Immigration Fairness Act (HRIFA) and most applications under the Nicaraguan Adjustment and Central American Relief Act (NACARA) is March 31, 2000. The NACARA applications that must be received by March 31, 2000 are those filed under section 202 of NACARA. This section covers Cubans and Nicaraguans. To be eligible for NACARA relief the applicant must have been continuously physically present in the US since December 1, 1995. However, derivative applicants – that is spouses and unmarried children under 21, need only be in the US when the application for adjustment is made. NACARA applications must be sent to the Texas Service Center. All HRIFA applications from principal applicants are also due by March 31, 2000. As with NACARA applications, the applicant must have been continuously physically present in the US since December 31, 1995. In both situations continuously physically present means that the person has not been outside of the US for more than 180 days. HRIFA applications must be sent to the Nebraska Service Center.
