The Immigrant Support Network (www.isn.org), a 10,000+ member organization formed in 1998 that describes itself as being “of and for people seeking legal permanent residency through employment-based immigration” is about to file suit against the INS in an attempt to force the agency to provide quicker processing of certain applications for adjustment of status.  Whether the suit is filed depends on the number of employment-based immigrants who are willing to participate as plaintiffs in the suit (and who meet specific criteria set out by ISN), and on whether ISN is able to raise all of the funds required to conduct a lawsuit.  Muthu Muthuraj of ISN recently released the following announcement on the possibility of litigation against the INS:

"You know ISN volunteers have been constantly working on furthering your interests in every possible front by whatever means available. For us who are working under H1-B visa, paying full-taxes, having no voting rights and a minimum of legal rights, there are only a few options available to seek remedy for the gross neglect and second rate treatment we have been receiving so far.

One of our biggest problems is the compounding processing delays at Department of Labor (DOL) and Immigration and Naturalization Services (INS).  ISN, and you as its member, have written numerous letters to the Senators, Representatives including the commissioner of INS directly about these issues. Our letters have failed to evoke any significant response so far.

So, as a part of the continuing efforts at ISN, as suggested by many of you, we have brought the option of a lawsuit (to seek justice and prevent damage to our future) to your doorstep. ISN has taken the first step with the confidence that you will take the necessary further steps to make this initiative a success. Please visit http://www.isn.org/litigation/ for further details.

At this juncture I am obliged to point out that it has taken an enormous dedication and volunteer hours to get to this point. I am sure it would take 100 times more effort to take it further. ISN is dependent on your support. Just to give you an estimate it has costed nearly 0 for the volunteers in terms of travel, phone calls etc apart from hours away from work including their time that would otherwise be spent with their family members.
