STATE DEPARTMENT PROPOSES FEE FOR AFFIDAVIT OF SUPPORT
The State Department has recently proposed a fee for the processing of Form I-864, the Affidavit of Support that must be filed with all family based immigrant visa petitions and some employment based petitions. The amount of the proposed fee is . Under the proposal, the fee would be charged only once, even if more than one Affidavit of Support was filed by the sponsor, so long as each one is essentially the same. In other words, a person can file immigrant visa petitions on behalf of multiple family members, but would only have to pay the fee once. In cases in which multiple affidavits are required, for example, if the first were rejected and then a joint sponsor submitted an additional affidavit, the fee would be charged for each one. Comments on the rule will be accepted until April 12, 2000. The rule is scheduled to take effect on June 1, 2000.
