SETTLEMENT REACHED IN HEALTHCARE WORKER REGULATION LITIGATION On September 29, 2000, the American Immigration Law Foundation (AILF) and the INS reached a settlement in AILF’s suit brought to compel the INS to issue regulations for healthcare workers. Part of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 imposed new requirements on healthcare workers immigrating to the US. Regulations for nurses and physical therapists were issued a few years ago, but only after AILF sued.
The INS has promised to have regulations dealing with the remaining healthcare workers – medical technologists and technicians, speech pathologists and physicians assistants – by January 19, 2001. Part of the settlement also requires the INS to present AILF with evidence relating to the status of the regulations in the administrative process by November 30, 2000, and confirming that they will be published by the January 19 deadline.
Despite the settlement, the lawsuit has not yet been dismissed.
