INS EMPLOYEE WINS DISCRIMINATION LAWSUIT
A female employee at the INS California Service Center won a case of sexual discrimination against the agency before the Equal Employment Opportunity Commission. Deanna Sebek, an administrative support service specialist, claimed she was assaulted by the former Service Center director, who dragged her down a hallway and pushed her.
An administrative judge with the EEOC found that Sebek’s claim of age discrimination failed because the director used the same abusive language with all employees, regardless of their age. In ruling favorably on Sebek’s claim of gender discrimination, the EEOC noted that she immediately reported the incident, but that the INS failed to take any disciplinary action.
The INS then appealed to the Department of Justice, which found that there was no discrimination because the director treated both male and female employees in the same manner. The full EEOC reversed the decision of the Justice Department, finding that the INS had full knowledge of the director’s actions and yet had repeatedly failed to discipline him.
Sebek was awarded ,000 in medical costs and 0,000 in other compensatory damages.  |
