The Supreme Court heard what is arguably the most important immigration case in a generation last week when the litigants in Arizona v. United States argued over whether a state is preempted from enacting its own immigration laws. The law in dispute is the infamous SB1070, the Arizona law that requires police in the state to check on the immigration status of individuals they “reasonably” suspect are in the country illegally. The press reported that based on questions asked by various Justices, that the US government is in trouble, but that’s really an oversimplification. In this issue, I’ll discuss the issues at the heart of the case and do a little prognosticating regarding how I think it will go.
