TEMPORARY PROTECTED STATUS EXTENDED FOR BOSNIANS AND SOMALIANS

The Immigration and Naturalization Service has extended the designation of Bosnia-Hercegovina under the Temporary Protected Status Program until August 10, 1998 and for Somalians until September 17, 1998. TPS status allows person who are from designated countries to legally remain in the US until extraordinary conditions in a particular country have subsided. Bosnia has been a TPS country since August 10, 1992 and Somalia has been on the list since September 1991. TPS is generally only available to Bosnians and Somalians who were granted TPS during the initial registration periods for their respective countries or who, in some cases, were in valid status during the initial registration period who later apply for TPS. They must have been in valid immigrant or non-immigrant status at that time. TPS aliens are also entitled employment authorization and should submit Form I-765 along with Form I-821 the Application for Temporary Protected Status. Even if employment authorization is not sought, however, the applicant must submit Form I-765 (though the filing fee would not be required if employment authorization is not being sought).
