TRANSPORTATION DEPARTMENT ISSUES REGULATIONS ON ACCEPTABLE IDENTIFICATION DOCUMENTS UNDER IIRAIRA
Section 656(b) of the 1996 Immigration Act provides that after October 1, 2000, a Federal agency may only accept as proof of identity a driver's license or comparable identification document that conforms to specific requirements, in accordance with Department of Transportation (DOT) regulations. On June 17, 1998, the DOT released a notice of proposed regulations. Comments must be received by August 3, 1998.
Once effective, all applications for driver's licenses and all driver's licenses must conform to these regulations. To apply for a driver's license or comparable identification document under the proposed regulations, a person would have to submit two identifying documents as listed in the regulations. The regulations also require all driver's licenses or comparable identification documents to contain certain form and security features and the social security number of the license holder.
