SENATE COMMITTEE SET TO REVIVE 245(I)
The Senate Appropriations Committee recently included in its FY 99 Senate Commerce, Justice, State Appropriations bill (FY 99 CJS Appropriations) a provision that would restore the 245(i) program. This program allows undocumented immigrants to remain in the United States and apply for a green card by paying a $1000 fine. Last year, the Senate and the House conflicted on whether to keep or end the program, so they extended it until January when it ended.
Supporters of 245(i), which include the President and the immigrant community, argue that during the three years that the program originally existed, it poured over $200 million per year into the INS exam fees account that aided the naturalization program. The revived program would fund both the detention and naturalization activities of the INS. Critics, such as the Center for Immigration Studies, argue that it rewards illegal immigrants and that the revenues earned from the program are not as important as enforcing the US immigration laws. The bill's supporters promise to attach a 245(i) extension amendment onto every bill it can until the measure finally passes.
