NEW H-1B LABOR CONDITION APPLICATION FAXBACK SYSTEM
Immigration lawyers across the country are reporting ongoing problems with the new Labor Condition Application Faxback system for H-1B cases. The new system promised to allow applicants to fax LCA forms to the Department of Labor and receiving an approval via fax in just one minute. Unfortunately, not only are approvals not being returned in a minute, many applications are not being approved at all. The new Department of Labor system is divided up into a West Coast Terminal (in San Francisco) and an East Coast Terminal (in Philadelphia). Both systems have been shut down numerous times due to technical problems and many lawyers are reporting that they are receiving no responses to their faxed applications. What is particularly frustrating is that processing are, in fact, taking several days instead of just a few minutes. The Department of Labor will not verify whether a form was received properly, while at the same time it is asking lawyers to wait a week to refile.
