PERMANENT RESIDENT WINS FIVE-YEAR BATTLE FOR READMISSION
After a five-year long struggle, Christopher Arnesen has been readmitted to the US. Arnesen, a citizen of New Zealand, lived in the US for almost 30 years. He returned to New Zealand in 1994 only because an employee of the Social Security Administration told him that to apply for federal disability benefits he had to do so in his country of citizenship. Arnesen has AIDS.
After his return to New Zealand, Arnesen battled bureaucratic red tape and a bout of illness that kept him there for over a year. When he tried to reenter the US, he was placed into exclusion proceedings because of his medical condition. He and his attorney argued that he never intended to give up his status as a permanent resident. Arnesen also has the support of the New Zealand Parliament. On October 29, 1999, an Immigration Judge agreed with him and ordered the INS to not block his reentry.
The INS has until November 29, 1999 to appeal the decision.
