SALVADORAN SOLDIER WINS SUSPENSION OF DEPORTATION
After 17 years, Rene Hurtado has obtained permanent residence in the US. Hurtado, who now goes by the name Rene Larin, was a member of the military in El Salvador during the late 1970s and early 1980s. He fled to the US in 1981 after resigning from the Salvadoran military because he did not want to participate in its acts of brutality.
However, stories in the media of his own participation in brutalities led the INS to deny his request for permanent residency. Hurtado denied the accuracy of these accounts, claiming they were based on poorly translated speeches he gave in Spanish. He also sought to avoid deportation by seeking asylum, claiming he would be murdered if forced to return to El Salvador. The Immigration Judge who heard the case did not rule on the asylum issue, but did issue an order suspending his deportation, saying he believed Hurtado’s version of events.
The INS has not yet announced whether it would appeal the decision.
