CALIFORNIA COURT UPHOLDS BAN ON BILINGUAL EDUCATION
A California appellate court has upheld the position taken by the State’s Board of Education that only individual families, not school districts, may apply for an exemption from the state’s ban on bilingual education.
In 1998 Proposition 227, approved by 61% of the voters, ended district-wide bilingual education programs. The lawsuit centered around another state law which provides for increased local control of schools by allowing local school districts to seek an exemption from statewide educational requirements. In its ruling, the court said this law could not be reconciled with Prop. 227.
Only parents can seek a waiver to obtain bilingual education, and only for children who are over 10 or have special needs.
