We have learned of an internal form the INS has created to help it adjudicate H-1B cases. The form, Form G-1020, contains four questions that must be answered for each H-1B petition adjudicated. The four questions are:
1. What is the highest degree or level of school this person has completed? (the form then offers nine choices, ranging from no diploma to doctorate degree).
2. What is the applicant’s major/primary field of study?
3. What is the applicant’s rate of pay per year?
4. What is the three-digit LCA code?
H-1B law and regulations do not require that the beneficiary’s educational documents be submitted. However, given these new questions, it may be wise to send such documents in, in order to avoid delay in adjudication because of a Request for Additional Evidence.
