VA WAIVER POLICY WHEN CHANGING FACILITIES DRAWS CRITICISM
Siskind, Susser, Haas & Devine has learned of yet another Veterans Administration (VA) waiver policy that is making life difficult for J-1 physicians. In cases where a physician sponsored for a J-1 waiver by the VA later leaves his/her post, the VA policy is to notify the INS to revoke the waiver that was previously issued even where the physician arguably meets the statutory and regulatory requirements regarding moving positions after granting of the waiver. This VA policy apparently applies even in cases where another VA facility is interested in hiring that physician. Critics say that the VA should have a more flexible policy and should include extenuating circumstances in favor of the physician.
