SC Appealing Decision in Immigration Lawsuit
The Associated Press reports that South Carolina has issued notice that it plans to appeal a federal judge’s ruling against most of the state’s tough new immigration law. U.S. District Judge Richard Gergel ruled that the part of the 2011 law that allows police to check the immigration status of people they stop could take effect. But he kept in place an injunction that he had issued earlier that blocked most other parts of the law. One of the provisions Gergel blocked made it a state crime not to carry immigration paperwork or for illegal immigrants to transport or house themselves. Gergel ruled the federal government, not the state, has the authority over keeping track of people in the U.S. who aren’t citizens.
