In 1990, Congress passes legislation creating a pilot program allowing an F-1 foreign student to work off-campus if: (1) he/she has completed one academic year and is in good academic standing; (2) he/she will not be employed off-campus for more than 20 hours per week during the academic term; and (3) the employer provides an attestation to the US Department of Labor and to the university that it unsuccessfully recruited for the position for at least 60 days and will pay the higher of the actual wage at the worksite or the prevailing wage for the occupation in the area of employment. All attestations would have expired June 30, 1995 and no new attestations could be filed. The Department of Labor has extended the filing period to July 31, 1995. The Department of Labor expects to have a new rule relating to the program available prior to the expiration, but as of the writing of this article, nothing has been released by the agency.
