Alexander Alienikoff, the INS’ Executive Associate Commissioner for Programs has stated publicly that the INS will investigate and prosecute certain testing agencies that assist in the preparation of naturalization applications. Those agencies which will be targeted are believed to be engaging in the unauthorized practice of law in violation of the representation requirement set forth in 8 CFR Part 292. The INS noted the provision is a consumer protection law designed to ensure that applicants for naturalization and other immigration services receive quality representation.

The INS stated that persons aware of violations of the law should bring the matter to the immediate attention of the local INS office, with a copy forwarded to the Naturalization Program of the Immigration and Naturalization Service in Washington. Alienikoff also noted that the INS is in the process of tightening its regulations concerning testing entities which will set additional controls necessary to strengthen the integrity of the testing process.
