Lori Scialabba, Deputy General Counsel for the INS, has stated in a letter to immigration lawyer William B. Cook that a receipt for a replacement Employment Authorization Document is adequate proof of employment authorization for purposes of complying with I-9 filing and other immigration requirements if the receipt is submitted to the employer with three business days of hire. The employee would then have to present to the employer the actual Employment Authorization Document within 90 days of his or her hire. Ms. Scialabba further noted that a receipt for an initial application for an Employment Authorization Document will NOT be satisfactory proof of employment authorization.
