ICE Agrees to Reopen Removal Proceedings in Same-Sex Marriage Cases 

The Immigration and Customs Enforcement’s Office of Principle Legal advisor (ICE OPLA) has announced that it will work with Motions to Reopen in regards to removal cases wherein the respondent is part of a “lawful, bona fide” same-sex marriage. These individuals are now eligible for forms of removal relief such as adjustment of status, cancellation of removal, derivative asylum, etc. Qualifying individuals should prepare a request to join Motion to Reopen and send it to the ICE OPLA office holding jurisdiction over the individuals’ removal proceedings.
