DHS Designates Yemen for TPS Status

Secretary of Homeland Security Jeh Johnson announced that due to ongoing armed conflict, Yemen has been designated for Temporary Protected Status (TPS), effective September 3, 2015 through March 3, 2017.

Eligible nationals of Yemen – and those without nationality who last habitually resided in Yemen – who are approved for TPS will not be removed from the United States and may apply for an Employment Authorization Document (EAD). Eligible applicants must register in the 180-day registration period between September 3, 2015 and March 1, 2016.

Applicants must undergo thorough security checks and be able to prove that they have been continuously physically present and continuously residing in the United States since September 3, 2015. Applicants must submit any TPS-related fees or file Form I-912, Request for Fee Waiver.

TPS Extended for Haiti

Secretary of Homeland Security Jeh Johnson announced an 18-month extension of Temporary Protected Status (TPS) for Haiti, extending the designation through July 22, 2017. Haiti was designated for TPS status after it suffered a massive earthquake in 2010.

Current TPS Haiti beneficiaries who wish to extend their TPS status must re-register before October 26, 2015. Eligible TPS Haiti beneficiaries who re-register before October 26th and request a new EAD will receive a new EAD with an expiration date of July 22, 2017. Some re-registrants may not receive their new EADs before their current EADs expire; therefore, all current TPS Haiti EADs with an expiration date of January 22, 2016 will automatically be considered valid until July 22, 2016.

To re-register, current TPS beneficiaries must submit:

  • Form I-821, Application for Temporary Protected Status (Re-registrants do not need to pay the Form I-821 Application fee)
  • The biometric services fee (or a fee waiver request) if they are 14 years old or older
  • Form I-765, Application for Employment Authorization, regardless of whether they want an EAD
  • The Form I-765 application fee, or a fee waiver request, but only if they want an EAD. If the re-registrant does not want an EAD, no application fee is required.
