CASE HOLDS FAILING TO COMPLETE I-9’S CANNOT BE CORRECTED DURING 10 DAY CURE PERIOD

EOIR’s Office of the Chief Administrative Hearing Officer has held that a restaurant could not fill out I-9s for the first time for employees during the 10 day period following an audit request by ICE and have the violation considered a mere technical violation. The failure is substantive and would be fined accordingly.
